Revision of ANA Conditions of Carriage(CARGO) and Conditions of Carriage By Charter Flight
All Nippon Airways filed an application with the Ministry of Land, Infrastructure and Transport to revised the ANA Conditions of Carriage (CARGO) and Conditions of Carriage by Charter Flights.
Our application to revise limitation of liability was approved on December 25, 2009.
Therefore, ANA Conditions of carriage will be revised as follows.
- 1. Effective Date
- : Revised Conditions of Carriage will be effective for Air Waybills issued
on and after December 30, 2009.
- 2. Background
- : The Montreal Convention 1999(MC99) Article24 requires review of Carrier's Liability Limit every 5 years, based on an inflation factor. The review revealed that there has been an inflation of 13.1% in recent five years. Consequently, ICAO has decided to revise Carrier's Liability Limit from 17 SDR per kg to 19 SDR per kg.
Change in liability limits requires revision of Conditions of Contract on
reverse side of the Air Waybills and ANA Conditions of Carriage.
- 3. Measures
- : Notwithstanding any effective conventions, ANA will apply liability limit of 19 SDR (MC99 level ) for all carriages.
ANA Conditions of Carriage is posted on ANA CARGO website.
- 4. AWB Conditions of Contract
- : Customers are allowed to continue use of current Air Waybills after this change takes effect, provided that the amended Resolution 600b (19 SDR per kg liability limit) will supersede any liability limitation stipulated there in.
